Terms of Service

Effective 12 October 2026

In short: use Nexsaya lawfully and kindly, keep your account safe, and remember that safety features help you reach people but don't replace emergency services. Your messages are yours, and we can't read them.

1. About these terms

These terms are an agreement between you and Nihar Kalyanam, United States ("we", "us") for your use of the Nexsaya app, website and related services (the "service"). By creating an account or using the service, you agree to these terms and to our Privacy Policy.

2. Who can use Nexsaya

You must be at least 18 years old, or the minimum age required in your country if that is higher, to use Nexsaya. If you are under the age of adulthood where you live, a parent or guardian must agree to these terms for you. You may not use the service if the law forbids you from doing so.

3. Your account

  • Register with accurate information and a phone number or email address you control.
  • Keep your phone, passcode, sign-in codes and PINs safe. You are responsible for activity on your account.
  • Your encryption keys live only on your devices. If you lose your phone or forget your locked-chats PIN, we cannot recover your messages.
  • Usernames must not impersonate others or mislead. We may reclaim a username that breaks these terms.

4. Acceptable use

You agree not to use Nexsaya to:

  • break the law, or help anyone else break it
  • share content that sexually exploits or endangers children, or any other content that is illegal
  • harass, threaten, bully, stalk or intimidate anyone, or encourage violence or self-harm
  • impersonate a person or organization, or mislead people about who you are
  • send spam, bulk or automated messages, chain messages, or scams
  • share other people's private information without their permission
  • use someone else's location or safety features to track them without their knowledge
  • infringe anyone's intellectual property or other rights
  • spread malware, or try to access accounts, data or systems you're not allowed to
  • interfere with, overload, copy, reverse engineer or resell the service, except where the law allows
  • create accounts by automated means or in ways that avoid our limits

You can block anyone in the app, and you can tell us about an account at support@nexsaya.com. If you send us messages from a chat you're in, we can review them, because you chose to share them. We may limit or remove accounts that break these terms.

5. Your content

You own what you send. To run the service, you give us a limited permission to store, transmit and deliver your encrypted content, for as long as needed to provide Nexsaya. Because your content is end-to-end encrypted, we cannot read it. You are responsible for what you share and for having the right to share it.

6. Safety features

SOS, live location, Walk me home, Safe arrival and fake call are tools to help you reach people you trust. They depend on your phone, its battery, signal, permissions and settings, and on the people you chose being able to respond. We cannot guarantee that an alert will be delivered, seen or acted on.

Nexsaya is not an emergency service. If you or someone else is in danger, contact your local emergency number straight away.

7. Games

Games are for fun. They involve no real money, betting or prizes, and you may not use them for gambling. Rankings and scores are kept on your phone and may reset.

8. Ideas board

Ideas, votes and comments you post are public to people using the app and are not end-to-end encrypted. Don't post personal or sensitive information. If we build something based on your idea, you won't be owed payment or credit, though we'd love to thank you.

9. Other services

Some features rely on other companies, such as app stores, SMS and email delivery, Sign in with Apple or Google, maps, and translation websites that you choose to open. Their own terms apply to how you use them. We aren't responsible for their services.

10. Our software and brand

We give you a personal, non-transferable right to use the Nexsaya app on devices you own or control. The Nexsaya name, logo and design belong to us. Nexsaya includes open-source software, listed in the app under Licenses, which is covered by its own licences.

11. Ending your account

You can delete your account at any time in the app. We may suspend or end your access if you break these terms, if the law requires it, or to protect other people or the service. Where reasonable, we will tell you why. Sections that by their nature should continue, such as disclaimers and liability, continue after your account ends.

12. Disclaimers

We work hard to keep Nexsaya secure and available, but we provide the service "as is" and "as available". To the extent the law allows, we make no promises that it will be uninterrupted, error-free or free of security weaknesses, or that messages or alerts will always be delivered. Some features are new and may change or be removed.

13. Liability

To the extent the law allows, we are not liable for indirect, incidental, special or consequential losses, or for loss of data, profits or goodwill, arising from your use of the service. Nothing in these terms limits liability that cannot be limited by law, or your rights as a consumer under the laws of the place you live.

14. Governing law and disputes

These terms are governed by the laws of United States, without affecting any mandatory consumer protections where you live. Before starting a formal dispute, please contact us so we can try to resolve it together.

15. Changes to these terms

We may update these terms as Nexsaya grows. We will update the date at the top, and for important changes we will tell you in the app before they take effect. If you keep using the service after that, you accept the new terms.
